Small scale Redwell Brewery are being asked by global mass market coma inducing energy pop producing and \u00a0fine purveyors of soapbox racing and madmen jumping off cliff top entertainment providers: Red Bull, to withdraw their trademark application because their names are too similar.<\/p>\n<p>The crap excuses Red Bull are coming out with include (and these are quotes from <a title=\"http:\/\/www.edp24.co.uk\/news\/red_bull_in_war_with_norwich_s_redwell_brewing_over_name_1_2334168\" href=\"https:\/\/twitter.com\/Redwellbeer\" target=\"_blank\">www.edp24.co.uk<\/a>):<\/p>\n<blockquote><p>[Redwell&#8217;s Trademark Application] \u201ccomprises Red Bull\u2019s earlier trademark \u2018red\u2019 as a whole, which is a prima facie for the similarity of signs.<\/p>\n<p>\u201cMoreover, all trademarks consist solely of English words and contain the common element \u2018red\u2019. The term \u2018well\u2019 is merely descriptive and therefore of no distinctive character at all.<\/p>\n<p>\u201cFurthermore the term \u2018bull\u2019 and the term \u2018well\u2019 share the same ending and just differ in two letters.<\/p>\n<p>\u201cThe ending \u2018ll\u2019 is identical and therefore the terms Red Bull and Redwell are confusingly similar from a visual as well from a phonetical point of view.\u201d<\/p>\n<p>\u201c&#8230;consumers &#8230; will easily consider the sign \u2018redwell\u2019 as a line extension under Red Bull, in particular that the goods and services offered under \u2018redwell\u2019 and Red Bull are coming from the same undertaking.<\/p>\n<p>\u201cThe consumer will thus be confused as to the origin of the services.\u201d<\/p><\/blockquote>\n<p>What Bullshit.
